These General Terms of Business apply to the webshop www.anka-jewelry.com owned by the business entity Anka Atelier d.o.o., Josipa Prikrila 14, VAT ID: 93234374530. For any information, please contact us via email at info@anka-jewelry.com or by phone at 091 238 5271.
These Terms of Business apply to customers residing within the European Union (hereinafter referred to as the EU). We also deliver goods outside the EU, but in such cases, you must arrange delivery terms by contacting us at info@anka-jewelry.com. Any individual with legal capacity who accepts our terms of business may become a customer, confirmed by placing an order. By placing an order for items through this online store, the customer confirms acceptance of the general terms of business. All prices exclude VAT and are displayed in euros. The procedures and terms of business (purchasing and selling) of goods through the online store are defined by the following parameters: customer registration, ordering, payment, delivery, returns, and product claims. The supplier of goods is ANKA ATELIER d.o.o., a limited liability company for trade and services (hereinafter referred to as ANKA). A customer is considered anyone who electronically orders at least one product and fills out the required information during registration. ANKA enables the purchase of the entire range of goods displayed on its website through the online store. The images displayed on the website are for illustrative purposes only. Photos, texts, and other materials may not be published, sold, publicly or privately shared, or used in any other way without the consent of ANKA. Any non-compliance with the terms of the preceding paragraphs of this article entails liability and an obligation to compensate for non-material damage. ANKA retains all copyrights on the use of photos, texts, and other published material in accordance with applicable Croatian laws.
Order and Confirmation
The customer orders products through an electronic order form. Products are ordered electronically by selecting a specific product and adding it to the cart. After selecting all desired products and clicking the ADD TO CART link, the system automatically guides you to pages where you must confirm the accuracy of the entered information and select a payment method. If you choose to pay online with cards, the system redirects you to secure pages where you will select the card type and provide the necessary details. Once we receive your order, you will receive a confirmation email confirming a successful order or purchase, depending on the chosen payment method.
Payment
Payment in our online store can be made in the following ways:
1. Cash on delivery to the courier upon receipt.
2. Card payments through the secure online Corvus Pay platform.
Order Cancellation
The customer may cancel the contract without giving a reason within fourteen (14) business days. The cancellation period begins from the day the customer receives the product. The customer must inform the merchant of the contract cancellation in writing. This can be done through a form sent by mail, as prescribed by the Consumer Protection Law. The contract is considered canceled when the merchant receives written notification. In the event of cancellation, the customer is obligated to return the product to the merchant at their expense within seven days of cancellation. Returned products must be complete, in original and undamaged packaging, with all associated undamaged parts, accessories, and documentation. If used products are returned, the merchant reserves the right to reduce the refund amount. The customer has the right to cancel the contract under the Consumer Protection Law, which addresses general provisions for distance contracts:
- The consumer may cancel any contract concluded by remote communication means without giving a reason within fourteen days.
- In the case of a sales contract, the period begins from the day the consumer or a third party designated by the consumer, who is not the carrier, takes possession of the goods.
- If the consumer ordered multiple items with one order that are delivered separately, the period starts from the day the last item or shipment is received.
The merchant agrees to refund the customer the full amount paid (increased by statutory interest at the rate of the business bank holding the transaction account) within fourteen (14) business days from receiving the written notice of contract cancellation, except in cases where the product has been used, in which case the merchant has the right to reduce the refund amount according to the value lost due to the product’s use by the customer.
Data Protection
Your personal data, which you voluntarily provide, will be stored in our customer database. We collect and use your personal data to process orders, send promotional materials, improve customer relations, and verify and authorize credit card payments, to the extent and time necessary to achieve each specified purpose. By registering as a customer, you consent to the processing of your data for the purposes mentioned in the Privacy Statement.
Your personal data is protected per the Croatian Personal Data Protection Act, and we will not make it available to third parties in any way. Necessary personal data will be shared only with business partners for order fulfillment or for mailing advertising materials. You have the right to request corrections, modifications, or updates to inaccurate, incomplete, or outdated data, and if you no longer wish to receive promotional material, you can unsubscribe from the mailing list by clicking the "unsubscribe" link or by requesting removal from our records at info@anka-jewelry.com. For any questions regarding data protection, you may contact our data protection officer.
We guarantee that we will not make your email address and other data available to third parties without your consent, as this would violate our privacy policy. We will seek your explicit permission if you wish to be contacted regarding special offers and promotions. Authorized executive government services in the Republic of Croatia are exempt for investigative purposes based on a valid court order.
ANKA ATELIER d.o.o. is not liable for accidental or force majeure errors or other objective circumstances that cause accidental breaches of guaranteed data protection, but it guarantees that any errors will be corrected as soon as possible if feasible.
Dispute Resolution
In the event of a dispute between the consumer and the merchant, a complaint can be submitted to the Court of Honor of the Croatian Chamber of Commerce, a mediation proposal to the Mediation Center, or to the European Commission through the online dispute resolution form ((https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=HR)). The merchant and consumer will strive to resolve any disputes amicably; otherwise, the Zagreb Court has jurisdiction.
